A 72-year-old man in New Mexico, USA was awarded US$412 million (S$553 million) after receiving unnecessary erectile dysfunction shots which severely damaged his penis.
On Monday (25 Nov), the jury awarded him US$37 million (S$49 million) in compensatory damages and US$375 million (S$503 million) in punitive damages.
The man’s legal representatives believe this may be the largest medical malpractice settlement in history as it’s expected to exceed US$550 million (S$739 million) including interest.
“Because of corporate fraud and greed, (the man) faces irreversible harm that has profoundly impacted his body and his life,” said one of the man’s attorneys.
He added that his client’s penis is now “completely ruined”. Besides being impotent and unable to have an erection, the man also cannot urinate standing up and has irreversible fibrosis or scarring on his penis.
“His impotence is permanent and the damage is completely irreversible,” the lawyers said.
The man underwent a treatment program which cost US$5,000 (S$6,722).
Testosterone pellets were implanted in his penis and a medical assistant provided him with penile injections to use at home.
When the man said the medication was not working, an assistant demonstrated how to administer the injection.
The man went home with a medically induced erection that would not go away and required an emergency surgery. The surgery ended up being unsuccessful.
NuMale, the nationwide clinic that the man visited, markets itself as a “Male Health and Wellness Center”.
NuMale President Brad Palubicki said the company is committed to patient care but declined to comment due to ongoing legal proceedings.
The man initially sought help from one of NuMale’s clinics in Albuquerque in 2017 for testosterone therapy and weight loss but was misdiagnosed with erectile dysfunction.
